The National Consensus Commission has finalized the draft of the July Charter after a series of meetings with political parties. It has already been sent to the parties. If there are any comments on the draft, they have been requested to submit it to the commission office by 4 pm on August 20.
The draft of the July Charter released on Saturday night states that the president can be impeached for treason, serious misconduct or violation of the constitution.
In that case, after the impeachment motion is passed by a two-thirds vote of the lower house of the legislature, it will be sent to the upper house and the impeachment process will be completed with the support of two-thirds through a hearing in the upper house. 28 parties and alliances have agreed to this proposal.
In terms of the presidential election system, it has been stated that the constitution will include a President of Bangladesh who will be elected by a majority vote of the members of both houses of the legislature (lower house and upper house) by secret ballot in accordance with the law. No person can hold any state, government or political party or organization office while running for the presidency.
Regarding the powers and responsibilities of the President, it has been stated that in order to balance the powers of the President and the Prime Minister and to increase the powers of the President, the President may, without any advice or recommendation, propose an amendment to Article 48 (3) of the Constitution and appoint the following positions within his/her own jurisdiction—
1. Chairman and members of the National Human Rights Commission. 2. Chairman and members of the Information Commission. 3. Chairman and members of the Bangladesh Press Council. 4. Chairman and members of the Law Commission. 5. Governor of Bangladesh Bank, Chairman and members of the Energy Regulatory Commission.
In addition, the Constitution replaces the President's power to grant pardons, and states that the President shall have the power to grant pardons, respite, remit or commute any sentence passed by any court, tribunal or other authority, and that power shall be exercised in accordance with the criteria, principles and procedures prescribed by law.
The relevant law shall provide that the consent of the plaintiff or the family of the aggrieved person shall be obtained before considering any such application. 29 parties and alliances have agreed to this proposal.
