Attorney General Md Asaduzzaman has said that the Supreme Court’s landmark ruling reinstating the non-party caretaker government system signifies the commencement of what he refers to as a “journey on the democratic highway” for the nation.

In a discussion with journalists on the court premises following Thursday's judgement, the Attorney General articulated that the verdict facilitates the assurance that the citizens of Bangladesh will have the opportunity to exercise their voting rights freely in the near future.

“Henceforth, individuals shall exercise their right to vote.” There shall be a cessation of any occurrences related to ballot stuffing prior to the election, and no deceased individual will present themselves at a polling station to cast a vote. He articulated a conviction that the nation is currently progressing towards a truly democratic path.

During the hearing on the caretaker government, Asaduzzaman presented a government submission alleging that former Chief Justice ABM Khairul Haque and his colleagues had violated Section 219 of the Penal Code in their earlier judgement that nullified the caretaker government system.

“The court has now rectified that mistake,” he stated, emphasising that the verdict embodies the populace's desire for elections that are free, fair, and transparent.

The Appellate Division of the Supreme Court, earlier on Thursday, reinstated the caretaker government system, thereby permitting the consideration of several civil appeals associated with this matter. Nonetheless, the stipulation regarding the caretaker government will be applicable to forthcoming elections.

On August 27, 2025, the Appellate Division permitted an appeal concerning its prior judgement that annulled the non-party caretaker government system established in 2011. The caretaker government system was established by the enactment of the 13th Amendment to the constitution in 1996.

The court issued its ruling following the consideration of several review petitions that called for the reinstatement of the 13th Amendment and the revival of the caretaker system.

Four review petitions were submitted by BNP Secretary General Mirza Fakhrul Islam Alamgir, Jamaat Secretary General Mia Golam Parwar, a group of five distinguished citizens, including SUJAN Secretary Dr Badiul Alam Majumdar, along with another individual petitioner. All petitions were considered concurrently.

On December 17, 2024, the High Court rendered a decision deeming the abolition of the caretaker government system as unconstitutional.
